End User License Agreement

tensorHVAC-Pro

This End User License Agreement (“Agreement”) governs your use of the tensorHVAC-Pro software (“Software”), developed and distributed by PT Tensor Karya Nusantara (“Licensor”).

By installing or using the Software, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Composition of the Software

tensorHVAC-Pro includes:

A proprietary graphical user interface (GUI), configuration tools, and project-management modules developed and owned by PT Tensor Karya Nusantara.
Integration with third-party open-source components, including but not limited to:
- OpenFOAM®, licensed under the GNU General Public License v3 (GPLv3)
- ParaView, licensed under a BSD-style open-source license
- Blender, licensed under the GNU General Public License v3 (GPLv3)

The Licensor does not claim ownership of these open-source components. They remain governed by their respective open-source licenses.

2. License Grant (for the Proprietary Components)

PT Tensor Karya Nusantara grants you a non-exclusive, non-transferable, revocable license to install and use the proprietary GUI and project tools of tensorHVAC-Pro on one computer, solely for internal engineering, simulation, or educational purposes.

You may:

Use the Software to set up, execute, and post-process OpenFOAM-based CFD simulations.
Make one backup copy for archival purposes.
Use the output data (results, images, plots) for reports or client deliverables.

You may not:

Decompile, reverse engineer, or redistribute the proprietary GUI.
Resell, rent, or sublicense tensorHVAC-Pro as a product.
Remove or obscure copyright or license notices from any included open-source components.

3. Open-Source Components and License Compliance

The open-source components included or interfaced by tensorHVAC-Pro are distributed in unmodified form and subject to their respective licenses.

Copies of the GNU General Public License v3 and BSD license texts are provided in the /licenses directory.
You may obtain the original source code for OpenFOAM®, ParaView, and Blender at their official repositories:

Your rights to use or modify those open-source components are defined exclusively by their respective licenses, not by this Agreement.

The proprietary GUI of tensorHVAC-Pro remains closed-source and is not a derivative work of OpenFOAM, but rather a tool that interfaces with it.

4. Intellectual Property Rights

All intellectual property rights in the proprietary GUI, user interface, and design of tensorHVAC-Pro belong to PT Tensor Karya Nusantara.
All rights in open-source components belong to their respective copyright holders.

5. Data and Simulation Results

All simulation data generated by the Software’s solver originate from OpenFOAM computation processes.
PT Tensor Karya Nusantara does not claim ownership over such data or simulation results; they belong to the user who generated them.

6. Warranty Disclaimer

The Software (including both proprietary and open-source components) is provided “as is.”
PT Tensor Karya Nusantara disclaims all warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose.
You assume full responsibility for any use or interpretation of simulation results.

7. Limitation of Liability

In no event shall PT Tensor Karya Nusantara or its affiliates be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the Software.
The maximum liability shall not exceed the license fee paid by the user for the proprietary portion of the Software.

8. Export and Compliance

You agree to comply with all applicable export, re-export, and import regulations and not use the Software in violation of any applicable sanctions or laws.

9. Termination

This Agreement is effective until terminated.
PT Tensor Karya Nusantara may terminate the license if you fail to comply with any term herein. Upon termination, you must uninstall and delete all proprietary components of tensorHVAC-Pro.

10. Governing Law

This Agreement shall be governed by the laws of the Republic of Indonesia, and any disputes shall be settled in the courts of Jakarta, Indonesia.

11. Acknowledgment of Third-Party Licenses

You acknowledge that the open-source components are distributed under their respective licenses, and your use of them indicates acceptance of those terms.

Trademarks OpenFOAM®, ParaView®, and Blender® are the property of their respective owners and are used here for descriptive purposes only.
